Who has the obligation to submit a declaration to the Cadastre?

Every person or legal entity that has real property or a registrable right on real property, is obliged to submit a declaration to the Cadastre. 
Specifically, all of the following are obliged to submit a declaration: every property owner who has a full or limited ownership right, every beneficiary of usufruct or any other personal or real easement (of any content), beneficiaries of a property assurance, seizure, registrable legal action, registrable lease (timesharing, financing or one lasting more than 9 years) and every beneficiary of a right that is registrable according to provisions of Law 2308/1995.
All who manage real estate properties that are not their own (e.g. a will administrator, a bankruptcy trustee, a vacant succession administrator, a will executor, a real estate property administrator etc.) are also obliged to submit a declaration.

 

Ways of Submitting a Declaration?

 

The declaration can be submitted in two (2) ways:

  1. On the web site of Ktimatologio.gr, through the application of e-KTIMATOLOGIO, e-services.
  2. In person, the beneficiary submits all the necessary documents to the relevant Office of Cadastre.

Step 1

  1. Declaration D1 / D2, completed and signed.
  2. Affiliated Forms in plain copies. Your ID or Passport, a paper to prove your Tax-ID number (E1 or E9 documents), copy of your contract (including the registry stamp).
  3. A surveying plan.

To locate your property, use the ktimatologio.gr Viewing Service by hitting "ΕΙΣΟΔΟΣ" at the bottom of the page and mark a line around your property. Then print the drawing and submit it amongst the other papers. 

In case a third party submits the statement instead of you,a simple authorization is required (provided that the rightfull owner has already signed the D1 form).

Step 2

The statement is checked by the Office's Engineer / Lawyer and, if the claim is supported by the documentation, the declaration is accepted.

The declared properties are located on a map by the Engineer, with the assistance of the owner. Sufficient information must be provided as the owner assumes full responsibility for his declaration.

Step 3

The declaration is entered into the system where the cadastral fee is automatically calculated.

The "ΠΡΟΣΩΡΙΝΗΣ ΚΑΤΑΧΩΡΙΣΗΣ ΔΗΛΩΣΗΣ & ΥΠΟΛΟΓΙΣΜΟΥ ΤΕΛΟΥΣ" ( exemplar ) form is issued with information about him / her, the declared property and his / her respective rights, the 20-digit payment code and the payment amount.

Step 4

The form is brought to the bank, so as to pay the amount due.

Two days later, the cadastral system is notified of the payment and a valid paper stating the conclusion of the declaration of property is issued. The owner may chose to get it in person, or as an email attachment.

 

Overdue Declaration

If you do not submit an ownership declaration to the Hellenic Cadastre in due time, you can submit an overdue declaration during the cadastral survey until the date that will be defined with a decision issued by the Ministry of Environment and Energy, as the end of the declarations, by filing the D2 - Declaration Form of Law 2308/1995. However, a fine may be apllied, in this case, depending on the type and value of the properties. It is noted that the procedure according to which the fine is decided and afterwards imposed may be activated at a later stage. Consequently, at this stage you do not pay a fine, but only the fixed fee following the familiar procedure at the co-operating banks.  

The ownership declaration to the Cadastre is mandatory by the law and constitutes a prerequisite for any action that involves the property in the future (e.g. transfer, parental benefit or donation). Specifically, if no declaration has been submitted for a property in an area under cadastral survey, then either the initial owner should first declare it and afterwards transfer it or the property should be transferred and afterwards declared by the new owner. You should be informed that a building permit cannot be issued for properties which have not been declared.

Instructions for Submission of Declaration of Law 2308/1995

Declaration Forms

D1 - Declaration Form of Law 2308/1995 D1 will be filed by people for the regions under cadastral survey from 2014 onwards.
D2 - Declaration Form of Law 2308/1995. D2 will be filed by legal entities for the regions under cadastral survey from 2014 onwards. It will also be filed by people and legal entities alike for the regions already under cadastral survey since 2008 (eg. Volos Municipalities).

 

Affiliated Documents

  • TO SUBMIT DECLARATION FOR INDIVIDUALS
  1. Completed and legally signed Statement Of Law No2308/1995 (provided in the office or the above links)

  • SUBMISSION OF A DECLARATION FOR LEGAL ENTITIES

When submitting the statement to the Cadastral Office, you must submit the following:

  1. Completed and legally signed Statement Of Law No2308/1995 (provided in the office or the above links)
  2. Property titles and documents substantiating property rights
  3. Photocopy of the ID card or passport and a document proving the TAX-ID number
  4. Copy of the Surveying Plan, provided tha there is one (if mentioned in the titles, it is obligatory). Otherwise the drawing print from the aerial services of Hellenic Cadastre Viewing Application here.
  5. Legitimate representation documents of the company.

Special Circumstances

  • Properties missing titles or in lack of titles

In case that there are no valid titles of ownership, the declaration can be sumbitted if there is constant and continuous possession of the property for at least 20 years. To prove such a claim,  at least two documents, such as: court order, affidavit, preliminary agreement, tax office E9 both modern and old one, building permit, loan document, electricity or water supply billing. 

  • Incomplete inheritance procedure with formal will of the deceased. 

In the case of inheritance rights for which inheritance has not been accepted through valid means, a declaration of property can be submitted. The valid papers to be submitted are: Title of ownership of the deceased, Certificate of Public Will from the Regional Court, Death Certificate,  Certificate of "No other" Will Published from the Regional Court, Certificate that the inheritance has not been forfeited.

  • Incomplete inheritance procedure without formal will of the deceased. 

In the case of inheritance rights for which inheritance has not been accepted through valid means, a declaration of property can be submitted. The valid papers to be submitted are: Title of ownership of the deceased, Death Certificate,  Certificate that the inheritance has not been forfeited, Certificate that "No will" has been published, Certificate of Closest Relatives to the deceased. 

 

Issuing of certificates

For issuing heritage certificates, you can contact different institutions depending on the type of certificate you need.Preferably, you can contact the appropriate Municipalities' Services or Regional Courts.

 

Payment of the Fixed Cadastral Survey Fee

The payment of the fee is carried out ​by presenting the pre-printed form of Temporary Registration Statement and Fixed Fee Esitmate.

For the financial facility of citizens, the National Cadastre & Mapping Agency S.A., from early 2017, provides the payment possibility of the fixed cadastral survey fee in interest-free installments by credit card, to the banks: ALPHA BANK, NATIONAL BANK OF GREECE, PIRAEUS BANK and EFG EUROBANK.

Banks and automated offices of the Hellenic Post Services network (ELTA)​ for the payment of the fee.

If you choose to submit your declaration on-line then the payment of the fee is possible only with a credit or debit visa and mastercard while using the relevant application.

 

Ways of submitting a declaration available to the expatriates

To better service expatriates, it was decided that for the submission of the property declaration to the Cadastre, instead of sending a proxy, Embassies / Consulates will issue a special authorisation with certified signature authenticity.

The options available to the expatriates are:

  1. If the declaration is filled out, signed and submitted by a third party on behalf of the beneficiary, it will be necessary to have a special authorisation with certified signature authenticity which can be provided by the Embassy/Consulate in their country of residence.
  2. By proxy already authorised with a special or general proxy document to administer their real estate in Greece. 
  3. By a third party with simple authorisation. In this case, beneficiaries should dispatch their filled out and signed declaration together with the necessary documents by post. The authorised person must submit the declaration to the competent Cadastral Survey Office. 
  4. For the first time, the declaration can be submitted on-line using a special IT application found on the HELLENIC CADASTRE website www.ktimatologio.gr. In this case, the necessary documents submitted with the declaration will be sent by post to the competent Cadastral Survey Office and the fixed fee is paid by credit card.
